Terms of Service

• dGENIX / we / us: the dGENIX platform, offered by dGEN Productions (KvK 97916137), Oudekerkstraat 45, 5507LB Veldhoven, Netherlands.
• User / you: any natural or legal person who creates an account on dGENIX.
• Service: the dGENIX platform, including the AI Assistant, skills marketplace, workflow automations and all related functionalities.
• Credits: the digital unit of account for use of the AI Assistant on the platform.
• Workflow Automation: a scheduled task configured by the user that is automatically and periodically executed by the AI Assistant.

These terms of service apply to all use of the dGENIX service and to all agreements between dGEN Productions and the user. By creating an account you agree to these terms.

Deviations from these terms are only valid if agreed in writing.

• Creating an account requires a valid email address and an access code.
• You are responsible for keeping your login credentials secure.
• You may not transfer your account to third parties without written consent.
• dGENIX reserves the right to block or delete accounts in case of abuse, fraud, or breach of these terms.
• You must be at least 18 years old to use the service.

• dGENIX offers monthly subscriptions. Current prices are at dgenix.com/pricing.
• Payment is processed via Stripe. You pay in advance per calendar month.
• Unused credits expire at the end of the billing period and are not refunded.
• If payment fails, the service will be temporarily suspended. After successful payment, service resumes.
• Price changes will be communicated at least 30 days in advance by email.

• Credits are only valid within dGENIX and have no monetary value outside the platform.
• Extra credits can be purchased via the dashboard and remain valid as long as your account is active.
• When your credit balance falls below the minimum buffer (100 credits), the AI Assistant stops automatically.
• Credits are personal and non-transferable.

It is not permitted to use dGENIX for:

• Distributing illegal, harmful, offensive or misleading content.
• Bypassing security measures or gaining unauthorised access to systems.
• Spam, phishing or other forms of unsolicited communication.
• Actions that violate Telegram's terms of service or other connected services.
• Commercial reselling or sublicensing of the service without prior consent.

In case of detected abuse, dGENIX reserves the right to terminate the service without prior notice.

• Skills are monthly add-ons billed separately via Stripe.
• You can deactivate a skill at any time via the dashboard. Billing stops at the end of the current billing period.
• Skills may require connecting external services (Telegram, Gmail). You remain responsible for your use of those services.
• Multi-Model add-on: when the Multi-Model add-on is activated, messages may be processed by external AI providers such as OpenAI and Google. Your input will be handled in accordance with their privacy policies. Only activate this add-on if you agree to this.
• Workflow Automations: scheduled tasks are automatically executed on behalf of the user. The user is responsible for the instructions and the outcomes of this automated execution. dGENIX accepts no liability for actions taken by the AI based on user instructions.
• Extra slot packs: available for Growth and Pro users. Slots are personal and non-transferable.

dGENIX aims for 99% availability but does not guarantee uninterrupted access. Planned maintenance will be announced in advance where possible. Unplanned outages will be resolved as quickly as possible.

dGENIX is not liable for damages resulting from temporary unavailability or disruptions in external services (Telegram, Anthropic, Stripe, Supabase, etc.).

The liability of dGEN Productions is at all times limited to the amount you have paid to dGENIX in the three calendar months preceding the damaging event.

dGEN Productions is not liable for indirect damages, consequential damages, loss of profits or loss of data. The AI Assistant automatically generates content; you remain responsible for reviewing and using this output.

All rights to the dGENIX platform, the software, the interface and the underlying technology belong to dGEN Productions. You receive only a non-exclusive, non-transferable right to use the platform for personal or internal business use.

Content you enter into the service remains your property. You grant dGEN Productions a limited licence to process this content to provide the service.

• You can cancel your subscription at any time via the dashboard. You will retain access until the end of the billing period.
• Refunds for paid subscription fees are not possible unless required by law.
• After deletion of your account, your data will be processed in accordance with the Privacy Policy.

These terms are governed by Dutch law. Disputes will preferably be resolved by mutual agreement. If this is not possible, the competent court in the district of Oost-Brabant has exclusive jurisdiction.

dGEN Productions reserves the right to amend these terms. For material changes, you will receive a notification by email at least 14 days in advance. Continued use of the service after the effective date constitutes acceptance of the new terms.
